Eligibility

You represent that you are of legal age to form a binding contract under the laws applicable to your jurisdiction, or that your legal guardian has reviewed and agreed to these Terms of Use on your behalf. If you are under the legal age of majority, you must have your parent or legal guardian's permission to use the Service. If you do not meet these requirements, you must not use the Service.

FixME reserves the right to modify these Terms of Use at any time. Any changes will be effective immediately upon posting on the Service or upon notification to you via other means. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms of Use. It is your responsibility to review these Terms periodically for any updates or changes.

 

License to Use the Service

FixME grants you a personal, non-exclusive, non-transferable, limited, and revocable license to use the Service solely for your personal, non-commercial use, subject to the terms and conditions set forth in this Agreement. Any use of the Service that is not expressly authorized by this Agreement is strictly prohibited.

User Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Service. Prohibited conduct includes, but is not limited to, harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Service.

 

Termination

FixME reserves the right to terminate or suspend your access to the Service at any time, without notice, for conduct that FixME, in its sole discretion, believes is in violation of this Agreement, any applicable law, or is harmful to the interests of FixME or any other User.

 

Limitation of Liability

To the fullest extent permitted by applicable law, FixME shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

 

Account

You may use your account solely for your personal, non-commercial purposes. You shall not share your account or login information, such as your Google Play account or Apple ID, with anyone, nor allow anyone else to access your account. You are solely responsible for maintaining the confidentiality of your login information and are fully responsible for all activities that occur under your account, whether or not you authorized them.

Account Security

You agree to protect the security of your account and login information. FixME is not responsible for any loss or damage arising from unauthorized access to your account due to your failure to secure your login information. If you become aware of or suspect any breach of security, including but not limited to the loss, theft, or unauthorized disclosure of your login information, you must immediately notify FixME and update your login information. Failure to promptly notify FixME may result in the loss of your account and any progress or data associated with it, for which FixME will not be responsible.

Ownership & License

FixME owns and reserves all rights, title, and interest in and to the Service, including without limitation any applications, titles, content, computer code, dialogues, concepts, artwork, animations, catch phrases, audio-visual effects, methods of operation, documentation, and server software (collectively, "Content"). All Content within the Service, including any updates or modifications, is the exclusive property of FixME and is protected by applicable intellectual property laws.

User Rights and Account Ownership

By using the Service, you agree that you do not own any rights or interests in the account you use to access the Service ("Account"). All rights to the Account are and shall remain the sole property of FixME. You further agree that any content or data associated with the Service, including virtual items or currency, has no monetary value and cannot be sold, transferred, or exchanged for real money or goods.

License to Use

FixME grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and use the Service for your personal, non-commercial purposes, subject to your compliance with these Terms of Use. This license is conditioned upon your continued adherence to these Terms, and any breach may result in the immediate termination of your license and access to the Service.

Restrictions on Use

Unless expressly granted permission by FixME in a written agreement, you may not:

• Reproduce, distribute, copy, exchange, modify, decompile, translate, or create derivative works from any Content provided through the Service.

• Lease, sell, license, or sublicense any Content or the Service itself.

• Deep-link to the Service for any purpose or access the Service using any automated process or device such as a robot, spider, or web crawler, except as specifically allowed by FixME.

• Incorporate any Content into any database, compilation, archive, or cache.

• Modify, copy, distribute, re-publish, transmit, display, perform, reproduce, publish, resell, license, create derivative works from, or transfer any information, content, material, software, products, or services obtained from the Service, except as specifically permitted under these Terms of Use.

Permitted Uses

FixME grants you permission to view and download individual pages of the Service for your personal, non-commercial use, provided that you do not remove any trademark, copyright, or other notices contained on such pages. You may share links to the Service via social networking platforms, provided that such sharing complies with these Terms of Use.

Prohibited Actions

You may not:

• Link to or frame any pages of the Service or any Content without prior written consent from FixME.

• Use the Service or Content for any purpose other than as expressly permitted by these Terms of Use.

FixME reserves all rights not expressly granted to you in this Agreement.

Enforcement of Rights

FixME reserves the right to enforce its intellectual property rights to the fullest extent permitted by law, including seeking legal remedies for any unauthorized use of the Service or Content.

License Limitations

While using any of FixME's Services, you agree that you will not, under any circumstances:

1. Exploit Vulnerabilities: Exploit, share, or distribute any errors, bugs, or vulnerabilities found within the Service, nor promote their use to other users in any form or manner.

2. Unauthorized Access: Attempt to access another user’s Account, collect or harvest personal information from other users, or attempt to obtain another user’s login information. You further agree not to attempt unauthorized access to the Service, including Accounts registered to others, or to any networks or systems associated with the Service. This includes, but is not limited to, bypassing or circumventing security measures or robot exclusion headers.

3. Prohibited Commercial Use: Use the content or information available through the Service for any commercial purpose or in any way that may cause harm to FixME. You acknowledge that unauthorized commercial use or republication of content may result in incalculable damages and agree that FixME shall be entitled to seek both temporary and permanent injunctive relief to prevent such activities.

Limitation of Liability

To the extent permitted by law, FixME provides the Service and all related content on an "as-is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the content, availability, or functionality of the Service. We do not guarantee that the Service will be timely, error-free, or free of defects, viruses, or other harmful components.

Subject to the foregoing, FixME and its directors, officers, agents, employees, and contractors shall not be liable for any direct, indirect, special, or consequential losses or damages, including but not limited to damages for loss of business, loss of profits, or other financial loss, arising from your use or inability to use the Service, whether based in contract, tort, or otherwise.

Nothing in these Terms of Use shall exclude or limit liability for death or personal injury caused by our negligence or the negligence of our agents or employees, or for any other liability that cannot be excluded or limited under applicable law.

The information, content, products, services, and materials available through the Service (whether provided by FixME, users, affiliates, or third parties) are provided "as-is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, FixME disclaims all representations and warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer viruses, and any implied warranties arising from the course of dealing or performance.

Intellectual Property Rights

The content available on the FixME mobile application and related services ("FixME Content"), as well as the trademarks, service marks, and logos contained therein ("Marks"), are owned by or licensed to FixME and are protected by copyright, trademark, and other intellectual property rights under the laws of the State of Kuwait and international conventions.

Scope of FixME Content

FixME Content includes, but is not limited to, all source code, databases, software, functionality, website designs, audio, video, text, photographs, graphics, and other material or content available through the Service. All graphics, logos, designs, page headers, button icons, scripts, and service names associated with FixME are registered trademarks, common law trademarks, or trade dress of FixME in Kuwait and/or other countries. These trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without prior written permission from FixME.

Use of FixME Content

FixME Content is provided to you "AS IS" for your information and personal use only. You may not use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any FixME Content for any other purposes without the prior written consent of FixME or the respective owners.

Prohibited Activities

Systematic retrieval of data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without prior written permission from FixME is strictly prohibited. You also agree not to circumvent, disable, or otherwise interfere with security-related features of the Service or features that prevent or restrict the use or copying of any FixME Content or enforce limitations on the use of the Service or the content therein.

Provided that you are eligible to use the Service, you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service and FixME Content. By using the Service, you acknowledge and agree that FixME may require you to accept and download updates to continue using or receiving support for the Service. These updates may include enhancements, improvements, or bug fixes and could be mandatory for continued access to certain features.

You further acknowledge and agree that FixME may introduce automatic updates, modifications, or patches to the Service, which may be applied without manual installation and with or without additional notice to you. Such updates are necessary to maintain, improve, or modify the Service and ensure its proper functioning. Your continued use of the Service constitutes your acceptance of these updates and modifications.

Termination

You acknowledge and agree that any violation of these Terms of Use, whether accidental or intentional, will result in the immediate termination of this agreement. Upon termination, you are required to cease all use of the Service immediately.

FixME reserves the right to terminate, suspend, or disable your Account at any time, for any reason or no reason, with or without prior notice. Such actions may be taken at FixME’s sole discretion, and you agree that FixME shall not be liable to you or any third party for any termination or suspension of your Account or access to the Service.

Upon termination of your Account or these Terms of Use, all rights granted to you under this agreement will cease immediately. However, your obligations under the following sections will survive any termination: “Ownership & License”, “License Limitations”, and “Intellectual Property Rights”.

Terms of Use Updates

You acknowledge and agree that FixME reserves the right to update, modify, or revise these Terms of Use or the Privacy Policy at any time. Any such changes will be published on our website at www.gulfengg.com/. The updated Terms of Use or Privacy Policy will become effective immediately upon their publication on the website. You are responsible for regularly reviewing the website to stay informed of any updates. Your continued use of the Service after any changes have been made constitutes your acceptance of the updated Terms of Use or Privacy Policy.

Please note that only the English version of this document has legal effect. Any translations of this document into other languages are provided for your convenience only and do not carry legal authority.

Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Kuwait. Any disputes arising out of or in connection with these Terms of Use, including non-contractual disputes, shall be subject to the exclusive jurisdiction of the Kuwaiti courts.

Enforcement

If any provision of these Terms of Use is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. No waiver by FixME of any breach of any provision of these Terms shall be deemed a waiver of any prior or subsequent breach, nor shall any waiver constitute a continuing waiver.
